1.ELIGIBILITY:This promotion is open to any person resident in the UK who is 13 years of age or older at the time of entry except employees of Microsoft Limited (“Microsoft”) and their respective subsidiaries, affiliates, advertising and promotion agencies and their immediate families (defined for the purpose of these Terms as husband, wife, mother, father, sister, brother, son, daughter, or persons residing in the household of such employees), and anyone else professionally connected with this Competition. The Promoter reserves the right to verify the eligibility of Entrants and check their identity. Entrants who are under eighteen must seek their parent or guardian’s permission before entering this Competition.
2. TO ENTER: Visit http://specials.uk.msn.com/tech/3-mobile-broadband/win-home-entertainment.aspx and answer the multiple choice question. Once you have answered the question you will automatically be entered into a free prize draw (regardless of whether you have answered correctly or incorrectly), to win a home entertainment system, or one of 20 runners-up prizes of a USB 3 dongle.
3. TIMING: This promotion runs from 09:00GMT on 05 May 2009. The closing date of this promotion is 23:59GMT on 19 June 2009. Please note the closing date of this promotion was originally 5 June 2009, however on 5 June 2009 it was extended by the Promoter until 19 June 2009.
4. USE OF DATA: Personal data which you provide will be used for future Microsoft marketing activity. The collection of personally identifiable information for the purposes of this promotion will be subject to the Privacy Statement at http://privacy.microsoft.com/. Specifically, the data collected through this promotion will be used to send an email to entrants to confirm where the entrant has won a prize. All personally identifiable information will be deleted approximately six (6) weeks after the Winners are selected. Additionally, Microsoft would like to pass your information to Hutchison 3G UK Limited so that they may contact you about future promotions, if you consent to this use please tick the box contained on this page http://specials.uk.msn.com/tech/3-mobile-broadband/win-home-entertainment.aspx. By entering this promotion, you expressly consent to the use of your personally identifiable information in accordance with the Privacy Statement.
5. SELECTION OF WINNERS: Microsoft will select the winner by random prize draw in the presence of an independent adjudicator before 26 June 2009. The winners will be notified by email or telephone within one (1) week of the drawing. In the event that the winner does not respond within a further one (1) week, the winner will be deemed to have forfeited the prize and an alternative winner will be randomly selected. The winner may be required to participate in publicity or advertising.
6. PRIZE: One 37 inch Sony LCD HD TV, one Sony Home Entertainment surround sound system, one Blu Ray DVD player, one Xbox 360 Elite games console including two Xbox 360 games and one additional wireless controller. No cash or other alternatives available.
7. WINNERS LIST: The winner consents to their surname being made publicly available. The winner’s surname will be available for a period of up to three weeks after the closing date by emailing prizes@microsoft.com.
8. OTHER: No correspondence will be entered into regarding either this promotion or these Terms and Conditions. In the unlikely event of a dispute, Microsoft’s decision shall be final. Microsoft reserves the right to amend, modify, cancel or withdraw this promotion at any time without notice.
9. Microsoft cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party. Entrants agree that Microsoft will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of the prize or from participation in this promotion. Nothing in this paragraph shall limit Microsoft’s liability in respect of death or personal injury arising out of its own negligence or arising out of fraud.
10. These terms, the conduct of this promotion and the interpretation and enforcement of these terms and conditions shall be exclusively governed and construed in accordance with the laws of England and Wales, unless you are a Scottish resident, in which case you may choose the law of your own country of residence. Entrants irrevocably submit to the non-exclusive jurisdiction of the Courts of England and Wales, unless they are a Scottish resident or a resident of Northern Ireland, in which case they may choose the courts of their place of residence.
