Prize Draw Terms & Conditions

1. ELIGIBILITY: This promotion is open to any person resident in the UK who is 13 years of age or older at the time of entry, except employees of Microsoft Limited (“Microsoft”) and their respective subsidiaries, affiliates, advertising and promotion agencies and their immediate families (defined for the purpose of these Terms as husband, wife, mother, father, sister, brother, son, daughter, or persons residing in the household of such employees), and anyone else professionally connected with this Competition (an “Entrant”).  The Promoter reserves the right to verify the eligibility of Entrants and check their identity.  Entrants who are under eighteen must seek their parent or guardian’s permission before entering this promotion (the “Promotion”).

2. TO ENTER: Visit http://specials.uk.msn.com/music/alcohol-survey.aspx and answer the multiple choice question. Once  you  have answered the question you will be automatically entered into a free prize draw, regardless of whether you have answered correctly or incorrectly, to win the Prize.

3. TIMING: This Promotion runs from 09:00GMT on 06 March 2009. The closing date of this promotion is 23:59GMT on 10 April 2009. 

4. USE OF DATA: The collection of personally identifiable information for the purposes of this Promotion will be subject to the Privacy Statement at http://privacy.microsoft.com/. Specifically, the data collected through this promotion will be used to send an email to the Winner  to confirm the Winner  has won the Prize. All Entrants’ personally identifiable information will be deleted approximately six (6) weeks after the Winner has been selected.

5. SELECTION OF WINNERS: Microsoft will select an Entrant by random prize draw in the presence of an independent adjudicator before 17 April 2009 (the “Winner”). The name of the independent adjudicator will be made available upon written request to the Promoter.  The Winner will be notified by email or telephone within one (1) week of the drawing. In the event that the Winner does not respond within a further two (2) weeks, the Winner will be deemed to have forfeited the prize and an alternative winner will be randomly selected from the other Entrants who correct answered the question.  The Winner may be required to participate in publicity or advertising in relation to this Promotion.

6. PRIZE: One Xbox 360 (256 MB memory unit) games console (the “Prize”). For the avoidance of doubt, there is only one Prize available to be won under this Competition.  No cash or other alternatives available.

7. WINNERS LIST: By entering the Promotion the Winner consents to their surname being made publicly available.  The Winner’s surname will be available for a period of up to three weeks after the closing date by emailing prizes@microsoft.com.

8. OTHER: No correspondence will be entered into regarding either this promotion or these Terms and Conditions. In the unlikely event of a dispute, Microsoft’s decision shall be final.  Microsoft reserves the right to amend, modify, cancel or withdraw this promotion at any time without notice.

9. The Promoter cannot guarantee the performance of any third party and shall not be liable for any act or default by a third party.  Entrants agree that the Promoter will have no liability whatsoever for any injuries, losses, costs, damage or disappointment of any kind resulting in whole or in part, directly or indirectly from acceptance, misuse or use of the prize or from participation in this promotion.  Nothing in this paragraph shall limit the Promoter’s liability in respect of death or personal injury arising out of its own negligence or arising out of fraud.

10. These terms, the conduct of this promotion and the interpretation and enforcement of these terms and conditions shall be exclusively governed and construed in accordance with the laws of England and Wales, unless you are a Scottish resident, in which case you may choose the law of your own country of residence.  Entrants irrevocably submit to the non-exclusive jurisdiction of the Courts of England and Wales, unless they are a Scottish resident or a resident of Northern Ireland, in which case they may choose the courts of their place of residence.
